A quotation from Ambrose Bierce

PRECEDENT, n. In Law, a previous decision, rule or practice which, in the absence of a definite statute, has whatever force and authority a Judge may choose to give it, thereby greatly simplifying his task of doing as he pleases. As there are precedents for everything, he has only to ignore those that make against his interest and accentuate those in the line of his desire.

"Columbia University agreed on Friday to overhaul its #protest policies, security practices and Middle Eastern studies in a remarkable #concession to the Trump administration, which has refused to consider restoring $400 million in #federal funds without major changes.
The agreement, which stunned and dismayed the faculty, could signal a new stage in the administration’s escalating #clash with elite colleges and universities. Harvard, Stanford, and dozens of other schools face federal inquiries and fear similar #penalties; college administrators said Columbia’s response to the White House’s demands may set a dangerous #precedent."

Columbia University was accused by the Trump administration of a systemic failure to protect students and faculty members “from antisemitic violence and harassment.”

#Monetization is a double edged sword and anyone who disagrees with that must counter this: that which is #unethical is #lucrative.

Let me repeat.

That which is unethical is lucrative.

The #liberals and #conservatives of the west has doped up our brains on delusions of grandeur (mass wealth accumulation) to the point where we stopped caring how we became wealthy.

Here's a hint: it wasn't #RuggedIndividualism, but pure exploitation - in the worst ways.

That's now a #market #precedent.

This exact issue was already litigated in 1898 in United States v. Wong Kim Ark. It was firmly decided by SCOTUS that all people born in the U.S. irrespective of the citizenship of their parents are born U.S. citizens (with, like, two very specific exceptions.) If the current court upholds this executive order, it would be an even more egregious violation of precedent than when they overturned Roe v. Wade.

Edit: seems I fell for some bad information. The pardoning mentioned by George H.W. Bush and Jimmy Carter are errors: they did not pardon family (despite some articles from otherwise typically reputable sources saying so, like Esquire). I apologize and commit to being more careful about checking things before I share them. I’m sorry about this.

In the lower #courts, #judges can serve for life. So the more a president appoints, the more he or she can shape the country. #SCOTUS hears only about 80 cases per year, meaning that lower courts are often the final arbiter on many issues. They set #precedent on #criminal #justice, #bankruptcy proceedings, #corporate disputes & #antitrust enforcement, & on whether federal #laws & rules are #constitutional.

Whether or not #Biden’s reform plan can pass, it is important that he has planted a flag in opposition to #SCOTUS — a marker for the next generation of #Democrats to work from. And VP #KamalaHarris …has already said that she will pick up the standard if elected in November.

“There is a clear crisis of confidence facing the #SupremeCourt as its fairness has been called into question after numerous #ethics scandals & decision after decision overturning longstanding #precedent,” Harris said…
