“Dismissing the case without prejudice would create the unavoidable perception that the mayor’s freedom depends on his ability to carry out the #immigration enforcement priorities of the administration, & that he might be more beholden to the demands of the federal government than to the wishes of his own constituents,” the judge wrote.

“Everything here smacks of a bargain: dismissal of the indictment in exchange for immigration policy concessions,” Judge Ho wrote. He said he found it “disturbing” that public officials might get special treatment from prosecutors by complying w/ #Trump’s policy goals.

Judge Dale E. Ho’s order to dismiss the case “with prejudice” spares #EricAdams from having to govern in a way that pleases #Trump or potentially risk having the #Republican’s #DOJ revive the charges.

The judge said he wasn’t opining on the merits of the case, but that courts can’t force prosecutors to move forward. Still, he expressed qualms about the govt’s move, saying “there are many reasons to be troubled” by its reasoning.

A federal judge dismissed #NYC Mayor #EricAdams#corruption case on Wednesday, agreeing it was the only practical outcome while blasting the #DOJ’s “troubling” rationale for wanting the charges thrown out — namely so the Democrat could help #Trump’s #immigration crackdown.

The judge, though, denied prosecutors the option to refile the charges after the mayoral election.

He recommended the case be dismissed “with prejudice”, meaning the charges could NOT be brought again.

“A dismissal without prejudice creates a palpable sense that the prosecution outlined in the indictment & approved by a grand jury could be renewed, a prospect that hangs like the proverbial sword of Damocles over the accused,” #PaulClement wrote in his filing.

Clement said he reached that conclusion in the face of the extraordinary circumstances of the #Trump #DOJ’s motion.

Under #Trump’s #DOJ? Sure.

A lawyer who was asked to offer *independent* arguments on the #Justice Dept’s motion to dismiss #corruption charges against #NYC Mayor #EricAdams of told a judge on Friday that he should end the prosecution.

But the lawyer, #PaulClement, said the judge should not allow the Trump admin to use the threat of #criminal charges to compel Adams’ political support.

"We're gonna be selling a gold card. You have a green card, this is a gold card. We're gonna put a price on that card of about $5 million and that's going to give you green card privileges, plus. It's gonna be a route to citizenship, and wealthy people will be coming into our country."

“Normally, courts are aided in their decision-making through our system of adversarial testing," Judge Ho wrote, “which can be particularly helpful in cases presenting unusual fact patterns or in case of great public importance.”

He said that because the #DOJ & the mayor both want the charges dropped, “there has been no adversarial testing of the government’s position.”
